Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS ("TERMS," "TERMS AND CONDITIONS," OR "AGREEMENT") CAREFULLY BEFORE USING THE SERVICES OFFERED BY WIZZGIFT LLC ("WIZZGIFT," "COMPANY," "WE," "US," OR "OUR"). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE WEBSITE AT WWW.WIZZGIFT.COM (THE "WEBSITE"), OUR MOBILE APPLICATIONS, APIS, AND ALL RELATED SERVICES (COLLECTIVELY, THE "SERVICES" OR "PLATFORM").

BY ACCESSING OR USING OUR SERVICES IN ANY MANNER, INCLUDING BUT NOT LIMITED TO VISITING OR BROWSING THE WEBSITE, CREATING AN ACCOUNT, OR MAKING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT ACCESS OR USE THE SERVICES.

THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT APPLY TO ALL CLAIMS BROUGHT AGAINST WIZZGIFT. PLEASE READ THEM CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS. THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER REQUIRE THAT DISPUTES BE RESOLVED THROUGH INDIVIDUAL ARBITRATION RATHER THAN JURY TRIALS OR CLASS ACTIONS.

Acceptance of Terms

By accessing, browsing, or using the Services, you represent and warrant that:

  • You are at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is greater
  • You have the legal capacity and authority to enter into a binding agreement with WizzGift
  • You are not prohibited from using the Services under the laws of the United States or any other applicable jurisdiction
  • You are not located in, under the control of, or a national or resident of any country subject to U.S. trade sanctions or embargoes
  • You will use the Services only for lawful purposes and in accordance with these Terms
  • All information you provide to us is accurate, current, and complete, and you will maintain the accuracy of such information
  • You will comply with all applicable local, state, national, and international laws, regulations, and rules

If you are using the Services on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms, and references to "you" shall include both the individual user and the business entity.

Your acceptance of these Terms creates a legally binding contract between you and WizzGift LLC. This contract governs your access to and use of the Services, and any orders or transactions you place through the Services.

Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

  • "Account" means a registered user account created on the Platform to access certain features and services.
  • "Affiliate" means any entity that directly or indirectly controls, is controlled by, or is under common control with WizzGift.
  • "Applicable Law" means all applicable laws, statutes, regulations, ordinances, rules, orders, decrees, judgments, and requirements of any governmental authority.
  • "Blockchain" means a distributed ledger technology that records transactions across multiple computers in a verifiable and permanent way.
  • "Business Day" means any day other than a Saturday, Sunday, or federal holiday in the United States.
  • "Content" means any text, graphics, images, music, software, audio, video, information, data, or other materials.
  • "Cryptocurrency" or "Digital Currency" means any digital or virtual currency that uses cryptography for security, including but not limited to Bitcoin (BTC), Ethereum (ETH), Litecoin (LTC), USD Coin (USDC), Tether (USDT), and other supported digital assets.
  • "Customer" or "User" means any individual or entity that accesses or uses the Services, whether registered or unregistered.
  • "Fiat Currency" means government-issued currency that is not backed by a physical commodity, such as United States Dollars (USD).
  • "Gift Card" means a prepaid stored-value card or digital code issued by a third-party retailer or brand that can be used for purchases at that retailer or brand.
  • "Intellectual Property Rights" means all patent rights, copyright rights, mask work rights, moral rights, trade secret rights, trademark rights, and any other intellectual property or proprietary rights.
  • "Issuer" means the third-party company, retailer, or brand that issues the Products we sell through our Platform.
  • "KYC" or "Know Your Customer" means the process of verifying the identity of customers to prevent fraud, money laundering, and terrorist financing.
  • "Loyalty Program" or "Rewards Program" means WizzGift's customer loyalty program through which Users can earn and redeem Points for Rewards.
  • "Mobile Recharge" or "Phone Top-Up" means the service of adding credit or airtime to a prepaid mobile phone account.
  • "Order" means a request by a User to purchase one or more Products through the Platform.
  • "Platform" means the Website, mobile applications, APIs, and all related services provided by WizzGift.
  • "Points" means the loyalty credits earned through the Loyalty Program that can be redeemed for Rewards.
  • "Privacy Policy" means WizzGift's privacy policy available at www.wizzgift.com/privacy-policy.
  • "Products" means the gift cards, mobile recharges, vouchers, digital codes, and other products and services available for purchase through the Platform.
  • "Registered User" means a User who has created an Account on the Platform.
  • "Rewards" means the products, services, discounts, or other benefits that can be redeemed using Points.
  • "Services" means all products, services, features, content, and functionality offered through the Platform.
  • "Transaction" means any purchase, sale, exchange, or other activity involving Products or the Account Balance.
  • "User Content" means any Content that Users submit, post, upload, or transmit through the Services.
  • "Verification" means the process of confirming the identity and other information of Users, including KYC procedures.
  • "Wallet Address" means a unique alphanumeric identifier used to send and receive Cryptocurrency.
  • "WizzGift," "Company," "we," "us," or "our" means WizzGift LLC, a Wyoming limited liability company, and its successors and assigns.

WizzGift is not a bank, money transmitter, or financial institution. We are a reseller of digital products and do not provide banking, lending, or investment services. Any references to account balances, credits, or funds refer solely to prepaid amounts held for the purchase of Products through our Platform.

Description of Services

WizzGift provides a digital platform that enables Users to purchase digital products from authorized third-party suppliers. Our Services include:

Gift Cards

  • Digital gift cards and e-gift cards from major retailers, brands, and service providers
  • Gift cards for various categories including retail, entertainment, gaming, dining, travel, and more
  • Both fixed-denomination and variable-denomination gift cards
  • Gift cards redeemable in multiple countries and currencies

Mobile Recharges and Top-Ups

  • Prepaid mobile phone airtime and data recharges
  • Top-ups for mobile carriers in multiple countries
  • Direct-to-number recharge services

Digital Vouchers and Codes

  • Digital codes for software, subscriptions, and online services
  • Gaming credits and in-app purchase codes
  • Subscription vouchers for streaming and entertainment services

Payment Methods

  • Cryptocurrency payments (Bitcoin, Ethereum, Litecoin, USDC, USDT, and other supported digital currencies)
  • Traditional payment methods (credit cards, debit cards) where available
  • Account balance payments for Registered Users

WizzGift acts solely as a reseller and intermediary. We purchase Products from authorized distributors and suppliers and resell them to our Users. We are not the issuer, manufacturer, or provider of the underlying Products, and we are not responsible for the terms, conditions, or performance of Products issued by third parties.

The availability of Products may vary by geographic location, and certain Products may be restricted or unavailable in certain jurisdictions. We reserve the right to modify, suspend, or discontinue any Products or Services at any time without prior notice.

Eligibility Requirements

To use our Services, you must meet the following eligibility requirements:

Age Requirements

  • You must be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater, to use the Services
  • If you are under the age of legal majority in your jurisdiction but at least thirteen (13) years of age, you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms
  • If you are under thirteen (13) years of age, you are not permitted to use the Services under any circumstances
  • We reserve the right to request proof of age at any time

Legal Capacity

  • You must have the legal capacity to enter into binding contracts in your jurisdiction
  • If you are using the Services on behalf of a company or organization, you represent that you have authority to bind that entity
  • You must not be legally prohibited from using the Services

Geographic Restrictions

  • You must not be located in, or a citizen or resident of, any country subject to comprehensive U.S. sanctions, including Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk, or Luhansk regions of Ukraine
  • You must not be on any U.S. government restricted persons lists, including the OFAC Specially Designated Nationals List, the Commerce Department's Denied Persons List, or the State Department's Debarred Parties List
  • Certain Products may only be available in specific countries or regions, and you agree to comply with all geographic restrictions

Technical Requirements

  • You must have access to a device with internet connectivity to use the Services
  • You are responsible for obtaining and maintaining all equipment, software, and services needed to access and use the Services
  • You are responsible for all charges from your internet service provider or mobile carrier
Account Registration and Security

While some features of our Services may be accessed without an Account, certain features and benefits require Account registration.

Account Creation

  • To create an Account, you must provide accurate, current, and complete information as requested in the registration form
  • You may register using an email address and password or through third-party authentication services (e.g., Google, Apple)
  • We reserve the right to refuse registration, terminate accounts, or remove or edit content at our sole discretion

Account Security

  • You are solely responsible for maintaining the confidentiality and security of your Account credentials
  • You must use a strong, unique password that you do not use on other websites or services
  • You must enable two-factor authentication (2FA) when it becomes available or if required by WizzGift
  • You must not share your Account credentials with any third party
  • You must immediately notify us at support@wizzgift.com if you suspect any unauthorized access to your Account
  • You are responsible for all activities that occur under your Account, whether or not you authorized such activities

Account Information

  • You agree to keep your Account information accurate, current, and complete
  • You must promptly update your Account information if there are any changes
  • Failure to maintain accurate information may result in suspension or termination of your Account

Account Liability

WizzGift shall not be liable for any loss or damage arising from your failure to comply with this section. You agree to indemnify and hold WizzGift harmless from any claims, damages, losses, or expenses arising from unauthorized use of your Account or your failure to maintain Account security.

User Tiers and Verification Levels

WizzGift implements a tiered user system to comply with regulatory requirements and manage risk. Your tier level determines your transaction limits and access to certain features.

Tier 1: Unregistered/Guest Users

  • No Account registration required
  • Daily purchase limit: $2,000 USD equivalent
  • Monthly purchase limit: $5,000 USD equivalent
  • Limited access to certain features and Products
  • Email confirmation required for order delivery

Tier 2: Registered Users

  • Account registration and email verification required
  • Daily purchase limit: $5,000 USD equivalent
  • Monthly purchase limit: $10,000 USD equivalent
  • Access to Account Balance and Loyalty Program
  • Order history and tracking
  • Basic phone number verification may be required

Tier 3: Verified Users

  • Full KYC verification required (government-issued ID, proof of address, selfie verification)
  • Daily purchase limit: $25,000 USD equivalent (or higher upon request)
  • Monthly purchase limit: $100,000 USD equivalent (or higher upon request)
  • Access to all Products and features
  • Priority customer support
  • Enhanced loyalty program benefits
  • Corporate and business accounts available

Tier 4: Enterprise/VIP Users

  • Enhanced due diligence required
  • Custom transaction limits based on business needs
  • Dedicated account manager
  • API access for bulk orders
  • Custom pricing and volume discounts
  • Available by application only

Verification Requirements

For Tier 3 and above, you may be required to provide the following documentation:

  • Valid government-issued photo identification (passport, driver's license, national ID card)
  • Proof of residential address dated within the last three (3) months (utility bill, bank statement, government correspondence)
  • Selfie or live photo for facial verification and document matching
  • Source of funds documentation for high-value transactions
  • Business registration documents for corporate accounts
  • Tax identification number or equivalent where required by law

We reserve the right to request additional documentation or information at any time, and to modify tier requirements, limits, or benefits without prior notice. Failure to provide requested documentation may result in transaction delays, reduced limits, or Account suspension.

Product Purchases and Transactions

This section governs the purchase of Products through our Platform.

Order Process

  • To place an Order, select the desired Product(s), choose the denomination and quantity, and proceed to checkout
  • Review your Order carefully before submitting, including Product details, denomination, and total amount
  • By submitting an Order, you make a binding offer to purchase the selected Products at the stated price
  • We reserve the right to accept or reject any Order for any reason, including but not limited to errors in pricing or Product information, fraud prevention, or compliance concerns
  • An Order is only accepted when we send you an Order confirmation email or deliver the Product

Order Confirmation

  • Upon successful Order acceptance and payment, you will receive an Order confirmation via email
  • The Order confirmation will include the Product code(s), redemption instructions, and Order details
  • Please verify all Order details immediately upon receipt and report any discrepancies within 24 hours

Transaction Limits

  • Transaction limits are determined by your tier level as described in the User Tiers section
  • We may apply additional limits based on payment method, Product type, geographic location, or risk assessment
  • Limits are calculated on a rolling 24-hour (daily) and 30-day (monthly) basis
  • Cryptocurrency transactions may have separate limits from fiat currency transactions
  • We reserve the right to modify limits at any time without prior notice

Order Cancellation

  • Orders cannot be cancelled once payment has been initiated
  • If you wish to cancel an Order before payment is completed, simply do not complete the payment
  • Once a Product code has been delivered, the Order cannot be cancelled under any circumstances
  • We may cancel Orders at our discretion if fraud, violation of Terms, or compliance concerns are identified

Processing Times

  • Most Orders are processed instantly upon payment confirmation
  • Cryptocurrency payments require blockchain confirmation before processing (typically 1-3 confirmations depending on the cryptocurrency)
  • Some Orders may be subject to manual review, which may take up to 24 hours or longer
  • Processing times may be longer during high-volume periods or system maintenance
  • We do not guarantee specific processing or delivery times
Payment Terms

This section governs the payment terms for Products and Services purchased through the Platform.

Accepted Payment Methods

WizzGift accepts the following payment methods, subject to availability in your region:

  • Cryptocurrencies: Bitcoin (BTC), Ethereum (ETH), Litecoin (LTC), Bitcoin Cash (BCH), USD Coin (USDC), Tether (USDT), and other supported digital currencies
  • Credit and Debit Cards: Visa, Mastercard, American Express, and other supported cards (where available)
  • Account Balance: Prepaid balance held in your WizzGift Account
  • Other payment methods as may be made available from time to time

Cryptocurrency Payments

  • Cryptocurrency prices are calculated at the time of transaction initiation based on current market rates
  • You must complete the cryptocurrency payment within 15 minutes of transaction initiation; failure to do so may result in Order cancellation or price recalculation
  • You are responsible for ensuring you send the exact amount to the correct wallet address on the correct blockchain network
  • Payments sent to incorrect addresses or on incorrect networks cannot be recovered and will not be refunded
  • Orders are processed only after the required number of blockchain confirmations are received
  • Transaction fees (gas fees, network fees) are your responsibility and are separate from the Product price

Credit and Debit Card Payments

  • Card payments are processed by our third-party payment processors (e.g., Stripe)
  • By providing card information, you represent that you are authorized to use the card
  • We reserve the right to request additional verification for card payments
  • Card payments may be subject to additional fees or restrictions
  • We do not store complete card numbers on our servers; payment data is handled by PCI-DSS compliant processors

Account Balance Payments

  • Registered Users may add funds to their Account Balance for future purchases
  • Account Balance is not interest-bearing and does not represent a deposit with a bank or financial institution
  • Account Balance may be used to purchase Products subject to available balance
  • Account Balance is non-transferable and may not be withdrawn as cash except as required by law
  • Account Balance may have expiration policies; see the Account Balance section for details

Pricing and Currency

  • All prices displayed on the Platform are in United States Dollars (USD) unless otherwise indicated
  • Prices may be converted to other currencies for display purposes; the actual charge may differ due to exchange rate fluctuations
  • Cryptocurrency prices are calculated based on current market exchange rates and may fluctuate
  • We reserve the right to change prices at any time without prior notice
  • Promotional pricing or discounts may be subject to additional terms and conditions

Taxes and Fees

  • Prices displayed may not include applicable taxes, duties, or fees
  • You are responsible for all applicable taxes, including sales tax, VAT, GST, or other transaction taxes
  • Network fees, blockchain transaction fees, and payment processing fees may apply and are your responsibility
  • We may collect and remit taxes on your behalf where required by law
Product Delivery

This section governs the delivery of digital Products purchased through the Platform.

Delivery Methods

  • Email Delivery: Product codes and redemption instructions are sent to the email address provided at checkout
  • Platform Delivery: Product codes are available in your Account dashboard (for Registered Users)
  • Instant Display: Some Products may be displayed on-screen immediately after payment confirmation

Delivery Timing

  • Most Products are delivered within minutes of payment confirmation
  • Cryptocurrency payments require blockchain confirmations before delivery
  • Some Products may require manual processing and may take up to 24-72 hours
  • Delivery times may vary based on Product type, supplier availability, and verification requirements
  • We do not guarantee specific delivery times and shall not be liable for delays

Delivery Failures

  • Ensure your email address is accurate and can receive messages from WizzGift
  • Check your spam/junk folder if you do not receive delivery within the expected timeframe
  • Add support@wizzgift.com to your contacts to prevent delivery issues
  • If you do not receive your Product, contact customer support within 24 hours of the expected delivery time

Mobile Recharge Delivery

  • Mobile recharges are delivered directly to the specified phone number
  • You are responsible for providing the correct phone number and carrier information
  • Recharges sent to incorrect numbers due to user error cannot be reversed or refunded
  • Delivery times for mobile recharges vary by carrier and country; most are instant but some may take up to 24 hours

Risk of Loss

Risk of loss for digital Products passes to you upon delivery of the Product code to your email address or Account. You are responsible for securing and protecting Product codes after delivery. WizzGift is not liable for any loss, theft, or unauthorized use of Product codes after delivery.

Refund and Cancellation Policy

Due to the digital nature of our Products and the fact that they become non-returnable once delivered, our refund policy is as follows:

General Refund Policy

  • All sales of digital Products are final once the Product code has been delivered
  • Gift cards, vouchers, and digital codes cannot be refunded, exchanged, or returned after delivery
  • Mobile recharges cannot be reversed or refunded once applied to the phone number
  • The digital and immediate-use nature of our Products makes them exempt from typical return policies

Eligible Refund Circumstances

Refunds may be issued only in the following limited circumstances:

  • Order Failure: Payment was received but the Product was never delivered due to a system error on our part
  • Invalid Product Code: The delivered Product code is invalid, expired upon delivery, or does not match the purchased denomination (documented proof required)
  • Duplicate Order: The same Order was charged multiple times due to a system error
  • Incorrect Product: The wrong Product was delivered (different brand or denomination than ordered)

Non-Refundable Circumstances

Refunds will NOT be issued in the following circumstances:

  • User Error: Incorrect email address, phone number, or other information provided by the user
  • Change of Mind: The user no longer wants the Product after purchase
  • Product Not Wanted: The Product code has been delivered successfully but the user cannot or does not wish to use it
  • Third-Party Issues: Problems with the Issuer's systems, redemption process, or terms and conditions
  • Price Changes: The price of the Product changes after purchase
  • Unauthorized Use: The Product code was used by someone other than the intended recipient
  • Regional Restrictions: The Product cannot be used in the user's location due to geographic restrictions
  • Carrier Issues: Mobile carrier processing delays or issues (if the recharge was successfully sent)
  • Already Redeemed: The Product code has already been partially or fully redeemed

Refund Process

  • To request a refund, contact support@wizzgift.com within 7 days of the Order date
  • Include your Order number, email address, and a detailed description of the issue
  • Provide any supporting documentation (screenshots, error messages, etc.)
  • Refund requests will be reviewed within 3-5 Business Days
  • Approved refunds will be issued to the original payment method or as Account Balance credit

Refund Method and Timing

  • Cryptocurrency Refunds: Refunds will be issued in the same cryptocurrency used for the original payment, at the current market rate or the original amount (at our discretion)
  • Card Refunds: Refunds to credit/debit cards may take 5-10 Business Days to appear on your statement
  • Account Balance Refunds: Refunds may be issued as Account Balance credit, which can be used for future purchases
  • Payment processor fees and network fees are non-refundable and may be deducted from refund amounts
  • WizzGift reserves the right to issue refunds as Account Balance credit at its sole discretion

Dispute Resolution

If you dispute a charge with your credit card company or payment provider before contacting us, we reserve the right to suspend your Account and pursue legal remedies. We encourage you to contact our support team first to resolve any issues. Filing a chargeback or payment dispute for a successfully delivered Product may constitute fraud and may be reported to appropriate authorities.

Gift Card Terms and Conditions

This section contains important information about the gift cards sold through our Platform.

Third-Party Gift Cards

  • Gift cards sold on our Platform are issued by third-party retailers, brands, and service providers ("Issuers")
  • WizzGift is a reseller of gift cards and is not the Issuer of any gift card
  • Each gift card is subject to the Issuer's own terms and conditions, which you must review and accept before use
  • WizzGift has no control over and is not responsible for the Issuer's terms, policies, or practices

Gift Card Redemption

  • Gift cards can only be redeemed at the Issuer's authorized locations, websites, or platforms
  • Redemption instructions are provided with each gift card delivery
  • Some gift cards may have regional restrictions and can only be redeemed in specific countries or regions
  • Gift card balances may be subject to expiration according to the Issuer's terms and applicable law
  • You are responsible for understanding and complying with the Issuer's redemption requirements

Gift Card Restrictions

  • Gift cards cannot be resold, transferred for value, or redeemed for cash except as required by law
  • Gift cards may not be used to purchase other gift cards unless specifically permitted by the Issuer
  • Some gift cards may have purchase limits, usage restrictions, or other limitations
  • Lost, stolen, or unauthorized gift card codes are not replaced or refunded
  • Treat gift card codes like cash; they are bearer instruments

WizzGift's Role

  • WizzGift provides the technology platform and fulfillment services for gift card purchases
  • We verify the validity of gift cards at the time of delivery
  • We do not control the redemption process and cannot assist with Issuer-related issues
  • For issues related to gift card balance, redemption, or the Issuer's products/services, contact the Issuer directly
  • We may assist with disputes but cannot guarantee resolution of Issuer-related issues

Important Disclaimers

WIZZGIFT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING GIFT CARDS, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WIZZGIFT IS NOT RESPONSIBLE FOR ANY LOSSES ARISING FROM THE ISSUER'S ACTIONS, POLICIES, BANKRUPTCY, OR FAILURE TO HONOR GIFT CARDS. YOUR SOLE REMEDY FOR ISSUER-RELATED ISSUES IS AGAINST THE ISSUER, NOT WIZZGIFT.

Mobile Recharge Terms

This section governs the mobile recharge and top-up services offered through our Platform.

Service Description

  • Mobile recharge services allow you to add credit, airtime, or data to prepaid mobile phone accounts
  • Recharges are delivered directly to the specified phone number through the mobile carrier's systems
  • Available carriers, denominations, and countries vary and are subject to change

User Responsibilities

  • You must provide the correct phone number, including country code and carrier information
  • You are responsible for verifying the number before completing the purchase
  • Recharges sent to incorrect numbers due to user error cannot be reversed or refunded
  • You must ensure the phone number is active and can receive recharges from the selected carrier

Delivery and Processing

  • Most recharges are delivered instantly, but processing times may vary by carrier
  • Some carriers may take up to 24-72 hours to process recharges
  • Carrier system outages or maintenance may delay delivery
  • You may receive an SMS confirmation from the carrier when the recharge is applied

Carrier Terms

  • Recharges are subject to the mobile carrier's terms and conditions
  • Credit validity, data package terms, and usage restrictions are determined by the carrier
  • WizzGift is not responsible for carrier policies, service quality, or network issues
  • For carrier-related issues, contact the mobile carrier directly

Refunds for Mobile Recharges

  • Mobile recharges are non-refundable once successfully delivered to the phone number

Loyalty and Rewards Program

WizzGift offers a Loyalty Program that rewards Registered Users for their purchases. This section governs participation in and use of the Loyalty Program.

Program Enrollment

  • Registered Users are automatically enrolled in the Loyalty Program
  • Guest Users do not earn Points; registration is required for program participation
  • Enrollment is free and does not require a separate sign-up

Earning Points

  • Points are earned on qualifying purchases made through the Platform
  • The earning rate is determined by WizzGift and may vary by Product, promotion, or user tier
  • Points are credited to your Account after the transaction is completed and verified
  • Points are not earned on cancelled, refunded, or disputed transactions
  • Bonus Points may be awarded for promotions, referrals, or special activities

Redeeming Points

  • Points can be redeemed for Rewards, including discounts, Products, or other benefits
  • Minimum Point thresholds may apply for redemption
  • Points are redeemed on a First-In-First-Out (FIFO) basis
  • Rewards availability may vary and is subject to change
  • Redeemed Points cannot be restored or reversed

Points Expiration

  • Points expire at the end of one (1) calendar year from the date of issuance
  • Expired Points are forfeited and cannot be restored
  • WizzGift will provide advance notice of impending Point expiration where feasible
  • Redemption or earning of new Points may extend expiration (check current program rules)

Program Modifications

  • WizzGift reserves the right to modify, suspend, or terminate the Loyalty Program at any time
  • Earning rates, redemption values, and Rewards may change without notice
  • We will provide reasonable notice of material changes to the program
  • Points have no cash value and cannot be sold, transferred, or exchanged for cash

Program Abuse

Any attempt to abuse, manipulate, or defraud the Loyalty Program may result in:

  • Forfeiture of all accumulated Points and Rewards
  • Suspension or termination of your Account
  • Revocation of earned benefits and tier status
  • Pursuit of legal action to recover losses
Account Balance and Credits

Registered Users may maintain an Account Balance to facilitate purchases on the Platform.

Adding Funds

  • You may add funds to your Account Balance using accepted payment methods
  • Minimum and maximum deposit amounts may apply
  • Funds added are available for use after payment confirmation
  • We may require additional verification for large deposits

Using Account Balance

  • Account Balance may be used to purchase Products on the Platform
  • Account Balance is applied automatically at checkout when available
  • You may combine Account Balance with other payment methods if permitted

Nature of Account Balance

  • Account Balance is a prepaid balance for use on the Platform only
  • Account Balance is NOT a bank deposit, e-money, or stored value product
  • Account Balance does not earn interest and is not FDIC insured
  • WizzGift is not a bank or financial institution
  • Account Balance represents a claim against WizzGift for future purchases

Withdrawals and Refunds

  • Account Balance is generally non-withdrawable and non-refundable
  • In limited circumstances, and subject to applicable law, you may request a withdrawal
  • Withdrawal requests may be subject to verification and fees
  • Certain jurisdictions may require refund of unused Account Balance; check your local laws

Expiration and Inactivity

  • Account Balance does not expire except as permitted by applicable law
  • Inactive Accounts (no login or transaction for 24 months) may be subject to inactivity fees or escheatment to the state as required by law
  • We will attempt to notify you before applying inactivity policies

Account Termination

If your Account is terminated, any remaining Account Balance may be forfeited if the termination is due to violation of these Terms. If termination is for other reasons, we will work with you to return any remaining balance, less any applicable fees, subject to verification.

User Conduct and Prohibited Activities

By using the Services, you agree to comply with all applicable laws and these Terms. You agree NOT to engage in any of the following prohibited activities:

Illegal and Harmful Activities

  • Using the Services for any illegal purpose or in violation of any applicable law or regulation
  • Money laundering, terrorist financing, fraud, or other financial crimes
  • Purchasing Products for resale in violation of Issuer terms or applicable law
  • Using the Services to evade taxes or sanctions
  • Purchasing Products with stolen payment methods, cryptocurrency, or funds
  • Engaging in any activity that could harm WizzGift, its users, or third parties

Fraudulent Activities

  • Providing false, inaccurate, or misleading information
  • Using a false identity or impersonating another person
  • Engaging in unauthorized access to others' Accounts
  • Filing false refund claims, chargebacks, or disputes
  • Exploiting pricing errors, system glitches, or vulnerabilities
  • Using automated tools, bots, or scripts to access the Services or place Orders

Technical Abuse

  • Attempting to gain unauthorized access to our systems, networks, or data
  • Introducing malware, viruses, or other harmful code
  • Interfering with or disrupting the integrity or performance of the Services
  • Reverse engineering, decompiling, or disassembling any part of the Services
  • Circumventing or attempting to circumvent any security measures
  • Scraping, crawling, or using automated means to access the Services without permission

Account Abuse

  • Creating multiple Accounts for the same person or entity
  • Sharing Account credentials with third parties
  • Using Accounts to circumvent transaction limits or verification requirements
  • Transferring or selling Accounts without authorization
  • Abusing the Loyalty Program, promotions, or referral programs

Intellectual Property Violations

  • Infringing on WizzGift's or any third party's intellectual property rights
  • Using WizzGift's name, logo, or branding without authorization
  • Copying, modifying, or distributing Content from the Platform without permission

Consequences of Violations

Violation of any prohibited activity may result in:

  • Immediate suspension or termination of your Account
  • Forfeiture of Account Balance, Points, and pending Orders
  • Reporting to law enforcement and regulatory authorities
  • Civil and criminal liability
  • Claims for damages and legal fees

Indemnification

You agree to indemnify, defend, and hold harmless WizzGift, its affiliates, officers, directors, employees, agents, suppliers, licensors, and successors and assigns (collectively, the "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms or any applicable law, regulation, or third-party right
  • Your User Content or any content you submit, post, or transmit through the Services
  • Your fraud, negligence, willful misconduct, or violation of any third party's rights
  • Any dispute between you and any third party related to the Services
  • Your failure to pay any applicable taxes or fees
  • Any claims by any third party arising from your activities on the Platform

WizzGift reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of any claim. You will not settle any claim without WizzGift's prior written consent.

This indemnification obligation will survive the termination of these Terms and your use of the Services.

  • You will comply with all applicable AML laws and regulations
  • You will provide accurate and complete information for verification purposes
  • You will cooperate with any investigations or information requests related to AML compliance

Suspicious Activity Reporting

WizzGift is required by law to file Suspicious Activity Reports (SARs) with the Financial Crimes Enforcement Network (FinCEN) when we know, suspect, or have reason to suspect that a transaction involves funds from illegal activity, is designed to evade reporting requirements, or has no apparent lawful purpose. We are prohibited from informing you if such a report is filed.

Sanctions Compliance

WizzGift is committed to compliance with U.S. sanctions laws and regulations administered by the Office of Foreign Assets Control (OFAC) and other authorities.

Sanctions Programs

We comply with all applicable sanctions programs, including but not limited to:

  • OFAC Specially Designated Nationals and Blocked Persons List (SDN List)
  • OFAC Consolidated Sanctions List
  • OFAC Sectoral Sanctions Identifications List (SSI List)
  • Comprehensive country-based sanctions programs
  • United Nations Security Council Sanctions

  • We may freeze or block Accounts and funds associated with potential sanctions violations

User Representations

By using our Services, you represent and warrant that:

  • You are not on any U.S. government restricted persons list
  • You are not acting on behalf of any person or entity on such lists
  • You are not located in or conducting transactions with parties in sanctioned jurisdictions
  • You will not use our Services to evade or violate any applicable sanctions
  • You will immediately notify us if your status changes with respect to sanctions eligibility

Consequences of Sanctions Violations

Violation of sanctions laws may result in civil and criminal penalties, including fines up to $20 million and imprisonment up to 30 years. WizzGift will report suspected sanctions violations to appropriate authorities and will cooperate fully with any investigations.

WizzGift implements Know Your Customer (KYC) procedures to verify the identity of our users and comply with applicable regulatory requirements.

  • Transactions inconsistent with user profile or stated purpose
  • Sanctions screening matches or potential violations
  • Device fingerprint anomalies or use of anonymization tools

Transaction Controls

  • Per-transaction limits based on user tier and verification level
  • Daily, weekly, and monthly velocity limits
  • Geographic restrictions based on IP address and user location
  • Device fingerprinting and fraud scoring
  • Automated blocking of high-risk transactions
  • Manual review queues for transactions requiring additional scrutiny

Actions We May Take

License Grant

  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our mobile applications on devices you own or control
  • This license is for personal, non-commercial use only
  • You may not copy, modify, distribute, sell, or lease any part of our applications

App Store Terms

  • If you download our app from an app store (e.g., Apple App Store, Google Play Store), you are also subject to that app store's terms of service
  • These Terms are between you and WizzGift, not the app store
  • The app store has no obligation to provide maintenance or support for the app
  • In case of any third-party claims related to the app, WizzGift, not the app store, is responsible

Updates and Changes

  • We may update the app from time to time to add features, fix bugs, or address security issues
  • You should enable automatic updates to ensure you have the latest version
  • We may require you to update to the latest version to continue using the app
  • We reserve the right to discontinue the app at any time

Device Permissions

Our mobile app may request access to certain features on your device, such as camera (for document verification), storage, and notifications. You can manage these permissions through your device settings, but some features may not work properly without the required permissions.

Termination and Suspension

This section describes the circumstances under which your use of the Services may be terminated or suspended.

Termination by You

  • You may terminate your Account at any time by contacting support@wizzgift.com
  • Upon termination request, we will close your Account after any pending transactions are completed
  • You remain responsible for all transactions and obligations incurred before termination
  • Account Balance remaining at termination may be refundable subject to our Account Balance policies and applicable law

Termination or Suspension by WizzGift

We may suspend or terminate your Account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or any applicable law or regulation
  • Suspected fraud, money laundering, or other illegal activity
  • Failure to complete required identity verification
  • Providing false, misleading, or fraudulent information
  • Chargebacks, payment disputes, or payment failures
  • Extended period of inactivity (no login or transactions for 12+ months)
  • Suspected sanctions violations or high-risk activity
  • Request from law enforcement or regulatory authorities
  • At our sole discretion for any reason or no reason

Effects of Termination

  • Upon termination, your right to use the Services immediately ceases
  • Any pending Orders may be cancelled
  • Account Balance and Points may be forfeited if termination is due to your violation of these Terms
  • We may retain your data as required by law or for legitimate business purposes
  • All provisions of these Terms which by their nature should survive termination shall survive

Account Recovery

If your Account is suspended or terminated and you believe this was in error, you may contact support@wizzgift.com to request a review. We will evaluate your request but are under no obligation to restore suspended or terminated Accounts.

Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time in our sole discretion.

Notification of Changes

  • We will post the updated Terms on the Platform with a new 'Last Updated' date
  • For material changes, we will provide additional notice (e.g., email notification, in-app alert, or prominent website notice)
  • We may require you to accept updated Terms to continue using the Services

Effective Date

  • Changes are effective immediately upon posting unless otherwise specified
  • Material changes may have a delayed effective date to give you time to review
  • Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms

Disagreement with Changes

If you do not agree to the updated Terms, you must stop using the Services and close your Account before the changes become effective. Your continued use of the Services after the changes take effect will constitute your acceptance of the revised Terms.

We maintain an archive of prior versions of these Terms. You may request a copy of a prior version by contacting legal@wizzgift.com.

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Agreement to Arbitrate

You and WizzGift agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or your relationship with WizzGift (collectively, "Disputes") will be resolved through binding individual arbitration rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

Informal Resolution First

Before initiating arbitration, you agree to first attempt to resolve any Dispute informally by contacting us at legal@wizzgift.com with a written description of the dispute, including your name, address, contact information, the facts giving rise to the dispute, and the relief sought. We will attempt to resolve the dispute informally within 60 days. If the dispute is not resolved within 60 days, either party may proceed to arbitration.

Arbitration Rules and Forum

  • Arbitration will be administered by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules and Procedures
  • The arbitration will be conducted by a single, neutral arbitrator
  • The arbitration will be held in Sheridan, Wyoming, or another mutually agreed location, or may be conducted telephonically or by video conference if appropriate
  • The language of the arbitration will be English
  • The arbitrator will apply the substantive laws of the State of Wyoming

Arbitration Costs

  • Each party will pay its own attorneys' fees and costs unless the arbitrator awards fees to the prevailing party
  • Arbitration filing fees and arbitrator costs will be shared as provided by JAMS rules, except that WizzGift will pay all filing fees and arbitrator costs for claims under $10,000 if you cannot afford them
  • If the arbitrator finds that either the substance of your claim or the relief sought was frivolous or brought for improper purposes, you agree to reimburse WizzGift for all fees

Arbitrator's Authority

  • The arbitrator has exclusive authority to resolve all Disputes, including the scope, applicability, and enforceability of this arbitration agreement
  • The arbitrator may award the same remedies as a court, including monetary damages and declaratory or injunctive relief
  • The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@wizzgift.com within 30 days of first accepting these Terms. The notice must include your name, address, email, and a clear statement that you wish to opt out of arbitration. If you opt out, you will still be bound by all other provisions of these Terms.

Class Action Waiver

YOU AND WIZZGIFT AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING.

Waiver of Class Proceedings

  • Neither you nor WizzGift may participate in a class action, collective action, or representative action against the other
  • The arbitrator may not consolidate more than one person's claims and may not preside over any class, collective, or representative proceeding
  • This waiver applies to both arbitration and court proceedings

Severability of Class Action Waiver

If any portion of this class action waiver is found to be unenforceable or unlawful, then that portion will be severed from this section, and the remainder of this section will be given full force and effect. If the class action waiver is found to be unenforceable with respect to a particular claim or request for relief, then that claim or request for relief must be severed from the arbitration and may be litigated in court, while the remaining claims or requests for relief must still be resolved through arbitration.

Governing Law and Jurisdiction

This section describes the laws that govern these Terms and where legal disputes may be resolved.

Governing Law

These Terms and any Disputes arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Jurisdiction and Venue

Subject to the arbitration agreement above, any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, United States. You consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

International Users

If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. These Terms are governed by U.S. law regardless of your location. Nothing in these Terms shall deprive you of any mandatory consumer protection rights under the laws of your country of residence.

Force Majeure

WizzGift shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control.

Force Majeure Events

Force majeure events include, but are not limited to:

  • Acts of God, natural disasters, earthquakes, floods, hurricanes, or other natural events
  • War, terrorism, civil unrest, riots, or armed conflict
  • Government actions, embargoes, sanctions, or regulatory changes
  • Strikes, labor disputes, or work stoppages
  • Epidemics, pandemics, or public health emergencies
  • Power outages, internet outages, or telecommunications failures
  • Cyberattacks, hacking, or security breaches affecting critical infrastructure
  • Failures or delays by third-party service providers, suppliers, or partners
  • Any other circumstances beyond our reasonable control

Effect of Force Majeure

If a force majeure event prevents us from performing our obligations, such obligations will be suspended for the duration of the event. We will use reasonable efforts to minimize the impact and resume normal operations as soon as practicable. We will not be liable for any losses, damages, or delays resulting from a force majeure event.

Assignment

This section describes restrictions on transferring rights and obligations under these Terms.

No Assignment by You

You may not assign, transfer, delegate, or sublicense any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.

Assignment by WizzGift

We may freely assign, transfer, or delegate these Terms and our rights and obligations hereunder, in whole or in part, without your consent, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

Binding Effect

Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.

Severability

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason:

  • Such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the intent of the parties
  • If modification is not possible, the provision shall be severed from these Terms
  • The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision
  • The remaining provisions of these Terms shall continue in full force and effect
No Waiver

The failure of WizzGift to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

  • Any waiver of any provision of these Terms will be effective only if in writing and signed by WizzGift
  • No waiver of any breach shall be deemed a waiver of any subsequent or prior breach
  • Our delay in enforcing any right shall not constitute a waiver of that right
  • All rights and remedies under these Terms are cumulative and not exclusive
Entire Agreement

These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and WizzGift regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

Order of Precedence

In the event of any conflict between these Terms and any other document or policy, the following order of precedence applies:

  • These Terms and Conditions
  • The Privacy Policy
  • Product-specific terms (if any)
  • Promotional or campaign-specific terms (if any)

No Third-Party Beneficiaries

These Terms are for the benefit of you and WizzGift only. Nothing in these Terms is intended to or shall create any third-party beneficiary rights, except for our affiliates and service providers who are intended third-party beneficiaries of certain provisions.

Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations.

  • You may not access or use the Services if you are located in a country subject to U.S. embargoes or sanctions
  • You may not access or use the Services if you are on any U.S. government restricted party lists
  • You may not export, re-export, or transfer any software or technology from the Services in violation of applicable export control laws
  • You represent that you are not prohibited from receiving U.S. origin products or services
Consumer Protection Rights

Nothing in these Terms is intended to limit or exclude any rights you may have under applicable consumer protection laws that cannot be waived or limited by contract.

Statutory Rights

  • If you are a consumer in the European Union, United Kingdom, or other jurisdictions with strong consumer protection laws, you may have additional rights
  • These Terms do not affect your statutory rights that cannot be waived by agreement
  • Where a provision of these Terms conflicts with mandatory consumer protection law, the mandatory law prevails

Right of Withdrawal (EU/UK Consumers)

For consumers in the European Union or United Kingdom, digital content (such as gift card codes) is exempt from the standard 14-day withdrawal right under the Consumer Rights Directive once delivery has begun with your consent and acknowledgment that you lose your right of withdrawal. By completing your purchase, you expressly consent to immediate delivery and acknowledge loss of the right of withdrawal.

The section and subsection headings in these Terms are for convenience only and have no legal or contractual effect. They shall not be used to interpret or construe any provision of these Terms.
